The date should be Aug. 10 as the calander stastes and not July 27 as is written on the sample. If you have aleady printed a notice

You should have received a mailing from Donna Kinney, Fiscal Administrative Officer for DEP. She sent out envelopes and a link to an electronic form to be used for month end reporting of sportsmen licenses. I put a link to that form in our Document Directory for your use. Also, she included the announcement that the Migratory Duck Stamp fee has increased. The new fee is $10.00. You still retain $0.50 and have to pay the DEP $9.50 for each stamp sold.

Governor Rell signed HB 6669, PA 05-235 on July 11. We have prepared a summary of the AB requirements as prescribed in section 3 of the Act. These were written for the candidates and campaign workers and should be distributed freely by the Clerks. Staff of the SEECworked with staff of the SOTS to finalize this summary.
The SOTS Office is currently working on written instructions for the Town Clerks that will facilitate implementation of the new requirements for consecutively numbering absentee ballot applications, registration of distributors and the like, which are contained in this Act. These instructions will be mailed to each Clerk, and hopefully posted on the Town Clerks’ Association website as well.
Finally, the same legislation makes certain changes to campaign finance laws that affect the duties of the Clerks and municipal candidates and campaigns. The SEEChas prepared written instructions for the Clerks which will be mailed before the end of the week and we will provide a copy to you for posting on the website.
Thank you for your cooperation, and we thank the Town Clerks who worked with us to achieve these reforms of the absentee voting laws which are intended to protect against abuse in that process.

I received the following notice from our lobbyist, Mike Dugan regarding SB 410:
Dear Laura,
I've attached a link to Governor Rell's press release following her signing into law Senate Bill 410, An Act Concerning Farmland Preservation, Land Protection, Affordable Housing and Historic Preservation." As noted in the press release, the Governor signed the bill into law because this legislation preserves "our history, protecting land from over-development and providing money for decent, affordable housing for our citizens. Each day, we lose more acres of farm
land and open space to developers. Each day we see historic homes and buildings razed to make way for cheaper new construction."
The Governor also stated that she had reservations about the funding source stating "the money it raises was not included in the state budget adopted by the General Assembly. So there are legitimate questions as to whether the funding mechanism violates the spirit, if not the letter, of our spending cap requirements." Despite these concerns the Governor felt this legislation is worthy of her signature.
The effective date was changed from July 1st to October 1st at the request of the Town Clerks Association, CATIC, Mortgage Bankers and the Connecticut Bankers Association. This added time will permit these organizations to prepare for this laws implementation.

The Governor signed the "conveyance bill" no. 6841 in to law on Friday. This means that the conveyance values of .0025 and .0050 are still in effect for two more years. I have just called the Governor's Office (at 4:15 6-30-05) and she has NOT yet signed the conveyance bill no 6841. Mike Dugan (our lobbyist) will continue to be in contact with the Governor's Staff right through the rest of the day. He will contact me as soon as learns the outcome. Please stand by !
Technically the Governor has until July 15th to sign this in to law . Until that happens we have to revert back to the old rate. As for those of you in the 18 targeted towns, I suggest you contact your town attorney to se if your local ordinance is affected. At yesterday's special legislative session they officially deferred the $30 surcharge on land records to October 1st. Separate from this action, there still is a possiblity that Governor Rell will either sign or veto SB 410 which is the surcharge bill. She has until July 11th to act on this bill. If she does not sign or veto, the bill automaticlly becomes law.
As for the conveyance bill , SB 6841 , the Governor received the bill yesterday . We have learned that she WILL address this bill by July 1st. Thus we will know where things stand real soon. Joe Camposeo

The Legislative leadership has amended SB 410. The change defers until 10/01/05 the implementation of the $30 surchargeon land recordings. If the Governor does not veto SB 410, the CTCA leadership will meet with OPM to make the reporting of the money reflect our needs. Our amendments for the vitals increase and electronic commission were excluded from the amendment to the OPM implementor bill. We are still hearing positive things about the Governor signing in to law the extension of the conveyance fees. We will keep everyone posted through this medium. Joe Camposeo
Congratulations to Joyce Mascena, CMC, Glastonbury Town Clerk who has been accepted into the Second Level Membership of the IIMC Master Municipal Clerk Academy. Joyce has been employed with the Town of Glastonbury since May 2003, serving as Town Clerk. Prior municipal service includes serving in the Towns of Vernon and Enfield. During the past sustaining period, she has completed IIMC-approved Academy Programs and has completed other seminars relating to government service. Joyce is an active member of the Connecticut Town Clerks Association, IIMC and the New England Association of City and Town Clerks.

SB 410 adds a $30 surcharge on every recording. It has passed in the legislature and now awaits the Governor's signature before it can become law. The implementation date is July 1. 2005. According to what was passed, town's keep $ 3 for LOCIP and $1 for town clerks. The remaining $26 is sent to the State Treasurer. Sandra Hutton , Laura Francis and I are hoping to have a meeting this week with the State Treasurers Office to develop procedures and get a lot of questions answered. As many of you may know The conveyance bill No. 6841 passed and is now on the way to the Governor for signing . According to the information we have, if the bill is signed in to law it will go in to effect on July 1, 2005 and will sunset on June 30, 2007. As many of you now know, the "conveyance bill #6841 passed the House early this morning. That is great news ! It appears that this will now be moved by the Senate and on to the Governor today. We will keep you posted through Sandra Hutton as things progress during the day. Mike Dugan also advised that he is working hard to get our vitals bill , and the electronic filing bill to be voted on by the House. If done they will both go to the Governor since they already have been passed by the Senate . The only obstacle of getting anything done could be the House Republicans causing delays by lengthy debates on all bills. Bill # 410 is now on it's way to the Governor for signing. More later. Bill 1227 Which increases the first vital copy to $10 and increase certifications to $2 , and make lifetime fishing licenss available to the handicapped. Passed in the Sanate and now is in the House.
Bill 6841 , The "Conveyanvce Bill" is going to be taken up first in the House of Reps , then the Senate. You can expect to see this taken up after they finish the "Budget" amendments later today. I have been told that the CCM and the Mayors have tallied about 90 supporters of this bill. That of course is good news, but there are no assuances on the Governor's intentions.
SB 410 , Raising recording fees another $30 for the first page is being debated in the House this morning. It has already passed the Senate !
SB 1295 Which creates the Electronic Recording Commission has passed the Senate and now awaits to be voted on in the House
HB 6669 Which modifies election registartion and AB processing is awaiting a vote in the House.

"My Building Official came into me this morning armed with Section 107.1 of the 1996 BOCA Code and explained to me that all lot line reconfigurations,
free/first cuts, even subdivisions/resubdivisions with existing houses on them, require a BUILDING PERMIT "prior to these activities commencing", and
always have. Apparently this is because there are certain fire restrictions depending upon how close a building is to another building or property line????"
Does anyone bring Mylar Maps to their Building Officials before recording? Has anyone ever run into this before? Anyone with any comments and/or

$40 Million in Municipal Aid at Stake
CONVEYANCE TAX IN TROUBLE!
CALL LEGISLATORS NOW
Prospects for extension of the current rates of the municipal real estate conveyance tax hit a snag Saturday when Governor Rell refused to agreed to include it in the negotiated state tax package to placate disgruntled House and Senate Republicans. Democratic leaders had asked that it be included in the package, but relented when Governor Rell balked.
The Governor’s refusal means that the bill (HB 6841) must pass both chambers of the General Assembly as a stand-alone bill during the last three days of the session (and then face gubernatorial action). Most Republicans in both chambers oppose the bill and several Democrats had stated they would likely oppose it if it were not part of the tax package.
HB 6841 is currently on the House floor, where the battle will first be fought.
Your Action Needed
Municipal leaders must call their state representatives immediately.
Tell Them:
· To support extension of the conveyance tax (HB 6841) without any amendments.
· To push their caucus leaders to bring the bill to a vote as soon as possible, and to oppose all amendments.
· That your community and local property taxpayers are counting on this revenue.
· Any amendment - no matter how attractive - may doom the bill.

The bill specifies how towns must use their share. The town clerks are to keep $1 and the remaining $3 must become part of the town's general revenue. Towns must use their share to fund the same types of projects that qualify for state Local Capital Improvement Program grants.
We are working with Sen. Williams and Sen. Coleman to increase the fee to include a fund for technology equipment and service contracts for clerks.
SB 1295, An Act Establishing an Electronic Recording Commission
This bill establishes an 11-member Electronic Recording Commission, 2 town clerks will serve on the commission, to recommend standards to be used in the development, implementation, and operation of a state real property electronic recording system. Under the bill, this is a statewide system that consists of information, databases, hardware, software, and all of the components of each town's electronic recording systems.
By February 1, 2006, the bill requires the commission to submit proposed legislation to implement the standards to the Judiciary and Insurance and Real Estate committees.
The state library placed a $210,000 fiscal note on this legislation. This fiscal note will require an amendment on the Senate floor stated this commission shall be done within available appropriations otherwise this legislation will fail in the Appropriations Committee.
HB 6841, An Act Concerning the Real Estate Conveyance Tax
The bill extends the current 0. 25% municipal real estate conveyance tax rate for two years, until July 1, 2007. Under current law, the rate is scheduled to drop to 0. 11% on July 1, 2005.
The bill also allows the 18 towns that currently have the option to add a flat 0. 25% to their basic municipal conveyance tax rate the option of adding a lower percentage up to 0. 25%.
This bill was referred by the House to the Planning & Development Committee a vote is scheduled today on this legislation.
SB 1227, An Act Concerning Fee Increases for Certain Vital Records and Lifetime Fishing and Hunting Licenses for Persons with Disabilities
This bill increases the fee for certifying a copy from the current $1 to $2. Increases the fee on vital records from $5 to $10 for additional copies of the same vital record the fee remains $5. For individuals that are permanently disabled they would be given a lifetime hunting, fishing or trapping licenses. For people with mental retardation they would be given a lifetime fishing license.
This bill awaits action by the Senate.
HB 6669, An Act Concerning Absentee Voting, Elections Enforcement, a Voting Technology Standards Board, Nomination Procedures, Training for Election Officials, Campaign Finance Reporting Restoration of Voting Rights and Voter Registration
This bill contains EDR, Elections Enforcements' Absentee Ballot reform provisions and several other proposals. The version of this legislation online will not be the version adopted by the House and Senate. CTC along with advocacy groups and various legislators have been participating in a work group to come up with a final draft of this legislation.
SB 55, An Act Concerning Voter Registration, Certain Nominating Procedures Campaign Accountability, a Voter Guide, Push Polling and Electronic Recording Machines
This bill seeks to makes several changes including requiring any voting machine to be constructed so as to produce and individual, permanent, voter verified paper record for each elector casting a vote on an electronic machine.
This bill awaits further action by the Senate.
HB 6617, An Act Concerning Elections
This bill requires a study of all election statutes.

If you still have copies of OP-236, Real Estate Conveyance Tax Return, with a revision date prior to May 2005 please continue to use them up through Friday, June 3, 2005. Ledyard - Patricia (Blaine) Karns, 70, former Ledyard town clerk, died Friday evening at Greentree Manor in Waterford. Mrs. Karns was born in New London on Feb. 1, 1935, the daughter of Edwin and Ruth (Paulson) Karns.
Mrs. Karns enjoyed a 28 year career with the Town of Ledyard, starting as asst. town clerk in 1970. In 1983, she accepted the position as town clerk, serving until her retirement in 1998. After her retirement, the town proclaimed a "Patricia Karns Day" in her honor.
She will be fondly remembered for always taking the time to listen others and for making them feel special. As a resident of Greentree, she served as president of the Resident's Council.
She was married to George C. Karns on Feb. 27, 1954 in Groton. He died April 1, 2002.
She is survived by three children, Scott Karns and his wife, Debora, of Moorpark, Calif., Sherrie L. Karns, of Groton, and Sheila R. Taurianen and her husband, William, of Ledyard; her siblings, Ted Blaine, of Montana, Edwina Wright, Donna Wandell, and Melissa Hinkle, all of Washington; three grandchildren, Todd Bridgeman, Nicole Clark, and Krystle Wood; and three step-grandchildren, Kathryne E. and Joshua Taurianen and Jacob A. Harper; as well as a special friend, Loretta Gomez.
She was also predeceased by two sons, Douglas and Patrick Karns.
Her family will greet relatives and friends at The Dinoto Funeral Home, 17 Pearl Street, Historic downtown Mystic on Wednesday from 5 to 8 p.m. Her service will be Thursday at 10:30 a.m. at the funeral home with burial following in Lambtown Cemetery, Ledyard.
In appreciation for the excellent care she received, the family requests donations in her memory to Greentree Manor Patient Recreation Fund, 4 Greentree Drive, Waterford, CT 06385 or American Diabetes Assoc., 300 Research Pkwy, Meriden CT 06450.

BERLIN -- Among their other duties, town clerks preside as official witnesses to the major events of life: births, marriages, divorces, property deals, military records - even deaths. Credit Berlin's town clerk, Kathryn Wall, for demonstrating that, far from being irrelevant and dusty, such records are a vital link to the past, present and future.Last week, Ms. Wall hosted the town's second annual Family History Day, an idea imported from Manchester, where she worked until being hired by the town of Berlin 31/2 years ago.The point of the program was to inform people who are interested in researching their family histories about the information available to them locally and at the state level. Tools for gaining access to this information range from computerized searches of databases to fragile, leather-bound volumes with hand-recorded entries dating to the 1700s.Residents taking part in Berlin's program were given a free consultation with a professional genealogist about researching land records and how to find out more about birth, marriage and death records, burial permits and military records. They also heard a talk by Walter Clebowicz, a probate judge for the Berlin-New Britain district, about records available through the court system.Janet Pestey, a professional genealogist, talked about records available through churches, city directories, the census, and passenger lists - even the Social Security Administration - for researching family histories.Attendees were able to visit the nearby Berlin-Peck Memorial Library to hear representatives of the Connecticut State Library and Archives, the Connecticut Society of Genealogists, the town's engineering department, the Connecticut Gravestone Network and the Daughters of the American Revolution.Thanks to the "seed" planted by Ms. Wall's program, a few family trees are sure to take root.

Re: Access to Marriage License Applications under the Freedom of Information Act
Dear Registrar of Vital Records:
In recent weeks, I have received several inquiries regarding access to marriage license applications under the Freedom of Information Act. I have spoken with the Office of the Attorney General on this matter to clarify whether the Freedom of Information Act applies to marriage license applications, as well as other vital records documents.
According to the Attorney General’s Office, the marriage license application, if created, is subject to the Freedom of Information Act. It must be made available upon request with the social security number redacted. However, since the provision requiring that marriage license applications be made available for public examination was repealed inOctober 2001, there is no longer any statutory language mandating that written application for a marriage license be made. Registrars are now allowed to verbally obtain the necessary data from the marriage applicants and enter such information onto the marriage license directly. This procedure may be currently in use by several towns that create marriage licenses electronically. Accordingly, if a marriage license application is created, it needs to be made available for public inspection with the social security numbers redacted.However, there is no requirement to create a marriage license application.
With regard to copies of birth, marriage, death and fetal death records, the Freedom of Information Act is not applicable. Connecticut General Statute §1-210 provides that all records kept by public agencies are public records “[except as otherwise provided by any federal law or state statute], . . ..”Therefore, the restrictions placed on access to birth and fetal death records under C.G.S. §7-51, and the restrictions placed on marriage and death records under C.G.S. §7-51a, supersede the broad access granted to the general public under the Freedom of Information Act.
C.G.S. §7-51 makes clear that access to birth and fetal death records is restricted to a few specified parties, and that members of the general public do not have access to these records. The statute also prohibits public access to birth and fetal death indexes.
Access to marriage and death records is governed by Connecticut General Statute §7-51a. This statute allows any person 18 years of age or older to obtain certified copies of marriage and death records. The law also specifies that the ‘Administrative Purposes’ section and the social security numbers listed on the marriage and death records must be redacted except when issued to a few specified parties. The fact that marriage and death records must be certified and that a portion of the document must be redacted precludes general access to these records.
Additionally, as explained in our Winter 2005 edition of the Vital Times, members of the general public do not have direct access to the vital records vault to view marriage and death records. Such a policy would contravene the confidentiality laws restricting access to social security numbers, as well as compromise the security of birth records. However, members of the general public may have direct access to marriage and death indexes, and request a certified copy of any record that they wish to purchase.
The $5.00 fee for a vital record is prescribed in law and is applicable to all vital records requests.Only requests for marriage license applications are subject to the fees specified under the Freedom of Information Act.

It was nice to see so many of you at the annual conference in Groton. Thank you (as an association) for helping us with the 12th Annual KOMEN
CT RACE FOR THE CURE for Breast Cancer on Saturday, June 11th, in Bushnell Park, Hartford from 7Am to noon. Many of you received brochures and an information sheet at the conference, but I will attach it to this email in case you need it. Also, everything is on our website www.komenct.org. Check it out!
We have heard from several clerks that they have appointed a Survivor Town Captain and/or have recruited a team to go to the race. Others have the brochures on their counters. The race is comprised of several different activities. A 5 K run (men 8:15AM, women 9:15)for those who can do it (I prefer walking!) A 4K Walk or a short Walk once around the park at 10:15AM. For the youngsters, there's a race at 11:15AM where everyone receives a medal. If you are a breast cancer survivor, there's a special breakfast at 7AM followed by a Survivors' March and group picture. There is also a special tribute to survivors at 11:30 AM to finish off the event. The Carousal is open for everyone all during the race at no cost. There's plenty of free food and drinks, a large sponsor area, and planty of activity. Bring your family and friends. MEANWHILE...if you have appointed a Town Captain, please send her name to the office by fax 860-728-1500. Also, if you have formed a team, let us know the name of that team so we can keep track of the Town Clerks' participation. Joanne Chrisoulis, a member of the Sponsorship Committee of the Race is heading up the Komen CT Town Captain Program .
